Learning Outcomes of the Course Unit

1) To understand characteristic of the method of İslamic law and its functions comparing to İslamic law;
2) To learn basic terms of the method of İslamic law and its development in historical process;
3) To learn basic literature of the methodology of İslamic law;
4) To explain fundemental and secondary sources of judgement of the method of İslamic law;
5) To compare the methods of “Hanefi” and “Mütekellimin” with the perspective of general systematic in the method of İslamic law;

The sources and methods of Islamic law: Kitab (Quran), sunnah, ijma (consensus), qiyas, maslaha, istihsan, urf, sedd-i zerai, sharu man kablena, statements of sahabe

Weekly Schedule

1) Definition of “Methodology of Islamic Law”, the birth, to be codified,
2) Historical development and the basic literature of “Methodology of Islamic Law”,
3) Sources of Shari'ah judgements: The Quran.

5) Definition of Sunnah, types, and value of the source of Sunnah
6) Definition of Sunnah, types, and value of the source of Sunnah
7) Definition of consensus (Icma) is, the realization conditions, types and source of value

10) Definition of qıyas , value of the source. The basic elements of qıyas and terms.
