Course Contents

This course provides students with the knowledge of zoning regulations, organizational structures of local governments, zoning applications, reading plans.

Weekly Schedule

1) The concept of zoning law, the concept of planning and zone planning
2) Sources of zoning law, spatial plans, types of spatial plans, spatial planning levels and relations, Hierarchy of Plans
3) Zoning plans, legal quality of zoning plans and their place in the hierarchy of norms, preparation and entry into force of zoning plans
4) Obligation to make zoning plan, things to be done before planning, principles to be considered while making zoning plan, authority to make zoning plan, special authority in zoning plan making.
5) Announcement of the zoning plans, suspension period and objections, the legal nature of the zoning plans and the types of lawsuits that can be filed for cancellation of them, appeal and appeal procedures. To strengthen the implementation of the subject, the precedents of the administrative court and the Council of State are also be discussed.
6) Midterm exam
7) Modification and revision of zoning plans, separation and merging operations.
8) Implementation of parcels, Article 18 of the Reconstruction Law and the acquisition of partnership shares.
9) Differences between regulatory partnership share and public partnership share, problems in practise.
10) Expropriation in zoning law, properties and principles of expropriation, concept of public interest
11) The implementation of the expropriation process, determination of the valuation commission, invitation and bargaining procedures to the owners, results of the process not ending with an agreement.
12) Lawsuits related to expropriation, determination of expropriation value and registration lawsuits, material correction case, legal seizure-actual seizure
13) Lawsuits related to expropriation, determination of expropriation value and registration lawsuits, expropriation price correction cases,
14) Expropriation annotation and its effect, legal confiscation and de facto confiscation
15) Council of State and administrative court decision review.
