Course Contents

Reforming administrative judiciary is among one of pledges in the extent of the integration process of Turkey’s membership for European Union. In this process, the primary task has been given to the courts of justice system in the whole judiciary system, and the Courts of Secondary Appeals (İstinaf Mahkemeleri) have been established by the law. However, reform projects for the administrative courts system are also on the government’s agenda. It is an important step in this reform project that the law has pre-conditioned -while the qualifications of judges were re-defined- most of the administrative court judges shall be chosen among the law school graduates. Solutions to the creation of an effective and ideal administrative judiciary in the process of Turkey’s integration into EU will be explored. Personnel needs of administrative judiciary, other structural needs, work-load of the Council of State, effective functioning of the Regional Administrative Courts, ensuring respect for, and execution of, the decisions and judgments of administrative judiciary, finding solutions in the light of the fundamental principles of the administrative law in cases of conflict between decisions and judgments of the administrative courts; and risk of transgressing borders by the administrative judiciary by infringing the administrative margin of appreciation.
