Learning Outcomes of the Course Unit

1) Understands the theological origins of the method of fiqh.
2) Knows the methods of mutellim and fukaha in the method of fiqh.
3) Explains the difference between the methods of fuqaha and mutakallim.
4) Compare and interpret the theological and jurisprudential views of different schools of Islamic thought.
5) Comprehends the contributions of the mutakallim proceduralists such as al-Baqillani, al-Juwayni, Qadi Abduljabbar and al-Ghazzali to the uzul of their theological orientations.

Course Contents

Types of writing in Fiqh Procedure, Fukaha, Mütekellim and eclectic method and the differences between them, theological issues in Fiqh Procedure; the rationality of husn-,qubh the certainty of the umum lafz, the shar'î illet and the issues of accuracy and error in ijtihad

3) Types of writing in usul al-Fiqh : Mutakallim and Fukaha Method
4) Those who wrote works according to the method of faqaha within the people and the reasons for their works
5) Among the Hanafis, those who wrote works according to the mutakallim method and their reasons for writing
6) The main differences between the method of the Fuqaha and the method of the Mutakallim
7) The opposition of the Samarkand school of Hanafis to the Baghdad school
